No Authority, No Vote: How the 287(g) Agreement Was Signed Without Council Approval

Tom Day did not have the authority on 2/6/26 to sign the 287(g) ICE agreement and the council knew and said nothing.
At the Council Meeting on January 5, 2026, the ONLY motion was to send a letter of interest to DHS
“Mr. Ginter made a motion to approve sending a letter of interest for the 287 G Program.”

Tom Day signed the 287(g) ICE Agreement on February 6, 2026 without the authority to do so. See posted Agreement.
The only authority he had was to send a letter of interest to DHS. Letters of recommendation were sent in order to get a copy of the ICE AGREEMENT. There was no authority to do so just from a motion to approve a letter of interest.
The Council knew that Tom signed the ICE Agreement during the Council Meeting on February 9, 2026. The Council made a show of listening to people when they already knew that the Agreement was signed. And the SIGNED 287(g) Agreement was not made public when it directly affects us.
Tom Day lied when he made this statement to Joe Cress on 2/9/26:
“Police Chief Tom Day said Monday that he has yet to submit the necessary paperwork.” He had already signed the ICE Agreement.
Tom Day lied when he told Joe Cress on 2/12/26:
“Day said that, so far, the borough has only submitted a written request to be accepted into the Homeland Security program. The application and formalizing the agreement has yet to be filed with federal authorities.”
Tom Day did not have the authority to do any of that because the Council had not yet voted on the 287(g) Agreement. But the Council new that Tom had already signed the agreement.
How can we trust Tom Day or the Council when they have clearly abused their authority and are bullying Mt. Holly Springs into accepting an ICE Agreement without proper Sunshine Act documentation?
The Sunshine Act prohibits decisions made behind closed doors without the public seeing any agreement that is entered into.
Then at the Council Meeting on 2/9/26 – NO QUESTIONS WERE ANSWERED! The rumor is that Tom Day ORDERED the Council NOT TO ANSWER ANY QUESTIONS!
Neither Tom Day nor the Council have addressed any of the issues brought up at the February 9, 2026, Council Meeting and they have not acted in Good Faith.
