The Public Deserves Answers: Key Questions on the 287(g) Agreement

The signed 287(g) Memorandum of Agreement expands policing authority in Mt. Holly Springs. Before this agreement proceeds further, residents deserve clear, documented answers.


Are there any MHS police reports that prove that a large number of truck drivers going through Mt. Holly Springs are undocumented?  Are there any police reports at all that show that an undocumented truck driver was involved in property damage in MHS?  Why hasn’t Tom Day made this information available?


Why wasn’t the Council given a sample copy of the ICE Agreement at the January 5 meeting so that risk could be assessed and costs could be estimated?  Copies of the ICE Agreement are readily available online.


Why has the Council not prioritized obtaining an opinion on risk and liability to protect Mt. Holly Springs from risk and cost?


Was the ICE Agreement given to a Solicitor/Lawyer to review for risk assessment?  If so, who was the Solicitor/Lawyer?  What information was he/she given to make an accurate assessment to protect Mt. Holly Springs?  What was his/her opinion?  Is it in writing?  If it is not in writing for Mt. Holly Springs citizens to see why not?  If a written opinion has been given, why hasn’t it been published?  If it was a verbal opinion, why hasn’t the Solicitor/Lawyer been asked to the Council Meeting to give an opinion?


In a February 27 Cumberlink/Sentinel article "Mount Holly Springs officials debate impact of ICE

agreement", the Police Chief stated that the public should not read too many “what-if” hypothetical scenarios into the agreement.

Asking hypothetical questions is how we assess risk and protect ourselves, the

citizens of Mt. Holly Springs from costs and liabilities. Why doesn’t Tom Day and the Council believe in properly assessing risk and cost to Mt. Holly Springs? 


Why is the Council solely relying on Tom Day’s opinion that an out-of-date flyer proves that DHS will give $100,000 for vehicles and reimbursements when the ICE Agreement clearly has no language about reimbursements?


Does Mt. Holly Springs have the liability insurance to cover constitutional violations by police and police acting as ICE agents specifically? Or will the taxpayers be on hook for any lawsuits from ICE/DHS mistakes?


Why were no projections for revenue or expenses made for the current Budget for the 287(g) Agreement?


Tom Day admitted that there is no population of undocumented immigrants in Mt. Holly Springs to the Sentinel.  Then WHY do we need to have our police force deputized as ICE Agents?


Show up March 9th and demand the council act in good faith.
